Making our Schools safe again ~

Making our Schools Safe Again

By Carl R. ToersBijns

There is an inherent desire to make our kids safe again in their schools. We have to look closely at what we need to do to return the normalcy that existed before the mass shootings that have spread across this nation puts a grip of fear into all of us creating havoc and poor plans to prevent this from happening again anywhere USA.

First we know this to be a severe condition aka lack of school security for the protection of our kids; something that won’t disappear or go away for quite some time.

Second we must identify all the symptoms related to the condition at hand and start a cycle of action and proactive planning to foster positive things back into our schools e.g. regenerating trust and calmness back into our schools.

Thirdly we must all work together to eliminate waste of resources and time and prioritize the energy and resources so that it will heal the not only the quickest but also the best way in the long run.

Fourth we must allow a “natural” condition to re-develop and aid in reformed thinking and emotions so we can unlock the anger, the sorrow and the pain that is present today.

For many parents and children the pain and sorrow may never go away but we must be reminded that the pain and sorrow is often more intense during the healing process than of the condition at hand.

We must avoid shutting down our common sense and our senses that control us physically, mentally and spiritually to maintain progress fighting this condition.

There needs to be a method developed to infuse beneficial and productive resources to allow the healing process to accelerate and at the same time reduce the side effects of the emotion and mental anguish we are all experiencing. There is no magic pill or solution to this matter.

With each infusion of positive and proactive achievement, we will improve the condition but it takes time and more resources to heal it completely. Removing or stopping these infusions of vital resources will allow the condition to reappear and become chronically worst.

This can’t be a temporary fix or act but rather a long range planned method of keeping the condition from redeveloping somewhere else or stagnates into another crisis.

We must endure conflict, controversy, and other crisis before the system can become balanced and safe again.

We must work with the expectation of teamwork and focus on defeating this condition to the point it won’t or can’t reappear and cause the pain and sorrow all over again.

Symptoms found in a preliminary finding are:

  • a neglected school system and lack of government activity or support to maintain them at the highest efficiency levels possible to enhance learning and protect kids
  • political apathy for the school system before mass shooting occurred.
  • lack of adequate resource officers inside schools due to funding or other political decisions to cut funding
  • lack of adequate physical plant precautions to avoid forced entry into school grounds
  • too many gaps and loopholes in the firearms background checks in the state
  • too many gaps between court reported mental illness on docket not reported to NCIS thus allowing firearms in the possession of those not eligible by federal law to possess them because of mental illness related illness that disqualifies them as gun buyers
  • lack of communication between mental health providers and law enforcement
  • lack of treatment alternatives for those with learning disabilities and illnesses throwing them into the criminal justice system without treatment or programs
I am sure there are more symptoms as there is no cure-all solution. This condition will have to heal under strict observation and management of professionals not politicians trained and skilled in the art of reviving poorly maintained security in such places as our schools and do so with the utmost cooperation of those in charge of public safety as well as providing adequate funding for public safety.

Email Privacy - the truth revealed

Email Privacy ~ Revealing the Truth

By Carl R ToersBijns

There is a misconception among email users that their email boxes are entitled to some kind of privacy protection that enables them to hide what is contained within their text and those email address used via the internet. What is alarming is the fact that hardly anybody realizes how easy it is to disclose and reveal what was once considered a confidential method of communicating and secure writings.

The most startling revelation is the ease of getting this information without a search warrant. Private emails are not as secure as we once thought they were and the method for accessing such information has become most simple since Congress passed a specific act way back in 1986, which makes this possible. E-mail "stored" for 180 days does not receive the same protection as E-mail in "process" less than 180 days.

It basically allows warrantless invasion of privacy actions if the text, email or electronic message is over 180 days old and no longer under the protection of search and seizure laws. Without taking into consideration the mass use and volume of internet traffic, the Electronic Communications Privacy Act of 1986 allows access to online chatting and other communications.

Just last month, on November 29, 2012, the Senate Judiciary Committee met and considered legislation to update the Act which would require police to get a warrant to read emails or other electronic communiqués. The current status of the Act only requires the showing of a § 2703 order that is specific and articulated facts relevant to an ongoing investigation.  This order can give a wealth of details about computing service usage. § 2703 (c)(1)(A)-(B) gives the contents of any relevant logs, all basic subscriber information (see below), cell site data for calls made, destinations of outgoing E-mail, and any other non-content records.
The burden for a subpoena[1] is a good sharp crayon. Electronic Communications Privacy Act “ECPA” as amended by USA PATRIOT § 210 (see 18 U.S.C. §§ 2701-11 for the bulk) yields Basic Subscriber Information which is defined as: name, address, local and long distance telephone toll billing records, telephone number or other subscriber number or identity, and length of service and types of service used by the customer, subscriber number (e.g. Internet address or telephone number)or identity (including any temporarily assigned network addresses), and means and source of payment for such service (including credit card or bank account number). It is all right there in Title 18.
As a bonus, the USA Patriot Act (sect 212 and 505) and Child Protection and Sexual Predator Punishment Act of 1998, 42 U.S.C. § 13032 also effect ECPA

Tackling your Dream - New Year Resolutions

Tackling your Dream
By Carl ToersBijns

The New Year is quickly approaching and we are all prepared to make some New Year resolutions. It is likely that some of these resolutions are part of your dream in life or the basis for making your dream come true. Either way, you are about to go on a journey that will hopefully fulfill your destiny.

We all dream of doing something special in our lives. We all dream of doing something that is satisfying someday. It may be a career change, raising a family, starting a business or become an artist in the music business or making a lot of money. Either way, you need to find a way to make your dream come true.

The world is made up of winners and losers. Not necessarily a nice way of putting it, the reality is that no matter what your dream is or was, there are some things thrown on those hard traveled tracks of this journey that makes it more difficult than once anticipated. Living a dream can be interrupted suddenly by something called fear. You shouldn’t be surprised or stunned this happens.

Fear is the number one reasons for not accomplishing your goals or dreams. It can happen to anybody and there are certain things you need to remember when encountered by fear.

First you have to be real. You must make a self-assessment of your skills, knowledge, abilities and experience as well as possessing the talent for acquiring such a dream.  The main thing to remember is that when you are pursuing a dream there will be a significant change in your life.

This change can spring many fears, challenges and insecurities at you as it will come from all directions that include where you live, how much money you have to support your dream and drumming up the intestinal fortitude to stay on this journey to capture your dream.

Most of all, you will be faced with the fear of failure. Change means leaving your comfort zone. It means taking different risks and making decisions never made before.  One may have to endure a change in the environment and endure misery before reaching your utopia.  You must learn to tolerate and overcome things that are strange and terrifying.  You must learn how to face and handle those risks that come with the territory of being successful.

We have come to appreciate that change is one of the most terrifying things we face in life. Our latent fears and insecurities spring out at us from all directions. After all, change threatens our comfortable worlds. It doesn't matter that our comfortable worlds might be miserable places. Misery we know! Misery we can tolerate! But change is strange and terrifying.

Whenever you are faced with the fear of failure or any other fear, don’t make excuses. Rely on your common sense that got as far as you are and rationalize the problem. This is where you go back to your self assessment and must decide if you have an adequate amount of money or levels of education, skill or experience to pursue your goals and happiness. Make adjustments to meet your shortage and focus on the positive things that this effort will bring you.

You must not squander time or money during these evaluation periods. You must make decisive decisions with or without help from others. Regardless, you must face the fear and march on. This is where you have winners and losers come or overcome and meet these challenges before you. Don’t let your fears shut you down.

Wading through the deep waters of fear and adversity is part of the challenges of success. Success will demand you to do or perform extraordinary things in your life. It is what makes you a great person rather than the normal status quo you are trying to leave behind. How you respond will make you either a winner or a loser.

Perseverance is a great quality to attain when pursuing your dream. Never give up even when the pain is so bad and you are terrified at the moment or the day after. If you focus on your dream you will never turn away and run away from it.

Be prepared for failure, humiliation, embarrassment and anxiety attacks. These all come with the challenge of attaining your dream. Don’t underestimate your own abilities when faced with the challenge of self expression, public speaking, organizing your thoughts and putting a plan together. Even though you may have “never” done such a task before, you will overcome your fear of failure if you have faith in all you do and prepare yourself adequately to get the job done.

Learn to identify your disabilities and accomplishments. It was said by Eleanor Roosevelt, a woman who was well versed with fear in her life that “you gain strength, courage, and confidence by every experience in which you really stop to look fear in the face.”

You must learn to attempt those things we think we cannot do and tolerate the fact that if it means going through life without knowing success, you merely exist and lose that dream. If we fail to attempt the thing we think we cannot do, it can mean the death of our hopes, dreams and our spirit. It could mean going through life merely tolerating our existence. It can mean dying without having risked or felt the sting of failure--or savored the joy of success.

When we face those things we thought we couldn’t do we become stronger and smarter in life. We gain heart and desires and leave behind cowardice and being scared. We have the appreciation of life and knowing that overcoming all these challenges as well as the fear was quite a feat and undertaking.

It underscores the importance of the journey and the discovery of new found strengths and wisdom that has been inside of you since the beginning and now moving you right along to live your dream. It became your own recipe for success and you now know that taking all those risks has paid off for you in many different ways.

Overcompensation ~ Is it a Bluff Confidence or Arrogance?

Is Overcompensation Confidence or is it Arrogance?

By Carl R. ToersBijns

It has been said often there is a thin line between being confident and being arrogant. Although the differences may be hard to tell you have to look closely to find what you are seeing is either overcompensation of feelings, ideas or tones and volumes motivated for a real unwarranted and raw materialistic or emotional power grab for control.

Some behaviors for example describe confidence such as being loud, expressive and in your face attitudes seem to reflect for many positive attributes of a person’s personality, characteristic or confidence.

Conversely, some feel that people who demonstrate their will, intelligence and voice silently, and in a cooperative manner can also display confidence but in a lower key manner that can be described as being aloof or other stereotypical comments that describes people.

The fact is that both are broad generalizations and must be applied to different situations. The main issue is whether or not either style attempts to draw a response of the subject at hand thus approach might deliver the desired response.

There is nothing mysterious about tone or volume associated with communication and behaviors. There are those persons who have a quiet confidence and there are those that possess a loud arrogance. The message is delivered in the manner desired for the situation.

Thus it is important to be able to distinct the different behaviors for different situations and conclude the difference between confidence and arrogance.

Realizing that some people can go about and take care of business in a quiet diligent manner yet draw the appropriate response and respect is another way to seek the proper attention for the occasion. Thus we have a quiet type versus the all mouth that is often described as being “all mouth and no action.”

Interestingly, people in general, either through their own social skills or indoctrinations or educational levels will resort to some sort of adjustment of approach to maintain an objective mechanism and control of the subject discussed or debated. This is where you need to have the ability to observe and look for superficiality and relate to the person’s motive or desire in such occasions.

So you must always ask a few questions about the situation as you wonder; are controlling people overly dominating because they actually feel out of control of the thing/person they are trying to control? Does this thing/person that they are trying to control scare them a little bit? Is this a matter of insecurity rather than being confidence or arrogance? You have to figure out just what the real deal is here so you can adjust your situational assessment and maintain control of what you want to say or do in such instances.

There is one rule a person must never forget. Whenever a person feels they are at a distinct or known disadvantage, they make try to manipulate the situation and overcompensate and become a little bit assertive, aggressive, more innovative or creative in their mannerism or approach.

My point is to simply be aware of such conditions as they may play into the part or act being performed to influence a desired outcome. This is most commonly known as a bluff.

When people feel they are being backed against the wall or cornered into a situation to fight or be controlled, it causes them to compensate for the occasion and may actually exceed and successfully deceive their personal capabilities to defend themselves effectively. Hence, when a person is at a disadvantage, this may motivate them to perform better and higher than ever before giving them the energy and drive to make things happen with unexpected results and successful conclusions.

Situational control is a very delicate process. It involved every capable human intelligence resource available to overcome either a physical or mental disadvantage and allows people to be smart enough and brave enough to try what was once impossible for them to think or do.

Thus it is fair to say that confidence and arrogance work hand n hand to accomplish personal feats when challenged and give them the desire to overcome personal barriers and be successful in the end. Another important lesson learned on human behaviors.

Using Social Media to Unravel the line

Why I can’t walk the line

By Carl R. ToersBijns

First and foremost let me say that I am trying to be a good person and tell the truth as I believe it is to the best of my ability. I know my writings or a word piss some people off and helps others understand the problem or matter more clearly. But this is done or accomplished not without some kind of rub or wrong feelings why it was said or done that way. Either way, it’s a no win situation as controversy only breeds contempt or dissatisfaction for some and informational insight to others.

I have mentioned several times that being a critic has no personal rewards nor does it warm up people to stand along side of you. You struggle through most of it alone and like anyone else doing what they think is the right thing to do, you suffer consequences in social content and contact that may impair your feelings for the moment but makes you realize your actions caused others to think and express what they feel about the issue at hand opening up their minds and thinking free or independently from others.

Everybody struggles with controversy. It’s usually divided between the good and the bad as well as the right and the evil way of doing things in life. I have and been living a worldly lifestyle that is expressing my thoughts and ideas via the social media as well as the news media. For that I will not apologize for as I believe in awareness makes things better and allows for change to occur. I want to bring change and this is how I stacked my tool box to do so.

Walking between the chasms of good and evil takes it toll and isn’t easy. Conflict is a hash and mean spirited thing when it attacks your heart, your soul and your mind, bending you one way or  the other making you wish you had conformed to walking the line and not stirred up such a mess. I’m sure there are others that feel this way but in all reality, it’s not for me. I don’t want to walk the line and conform; I want to move that line in one direction or another to make it better.

It is with great certainty that my works, my thoughts and my memory will be eclipsed once I die. I am hoping that some of my words bring happiness to some and resolution for others. I believe I will be forgiven for my sins done and for not walking the line. As for me to tow this line of neutrality cannot and will not be done in this lifetime.

I will not succumb to surrender or the silence it requires to be politically correct walk the line. It is not that I like to live on the edge of life but rather I resent and resist elements of evil men or groups menacing people’s rights and the distribution of sinful temptation to do nothing or just follow  and go with the flow.

I will behave according to my spirit, my soul and my values of life and its ethical content. I will work hard to repress regret and lost friendships but I will be overly empathetic to those who are impacted by the negativity in their lives, their workplace or their hearts.

My thoughts are ambiguous to some and clear to others. That’s the reality of controversy or crisis management as it stands. I don’t think I am right all the time and I certainly don’t think I have all the answers but one thing I do know and that is to stand still, remain silent and do nothing is not something I could accept nor do I wish others do so as well.

My tone may be subvert and loud and uninvited. I challenge the fact that not everyone wants to hear or deal with other people’s thoughts or ideas and refuse to listen or deal with the problems discussed or recited. That is just one of those things we do when we decide to be passive or aggressive in the manner we stand up for ourselves or others.

People must know I take risks and live in a state of jeopardy as there may be a time where a fanatical interpretation of my ideas or thoughts becomes offensive enough to act out on and deliver a blow to freedom of speech or freedom of the press.

Sometimes I act foolish to draw out the heat and sometimes I play coy to see what you are thinking. Either way, it’s my way to learn more about people and how they act, learn and play this game of life.

Neither tricking nor manipulating the outcome, my voice only speaks what needs to be said. Everything else is irrelevant and left unspoken.

Lastly, I am not a divided man. I am not torn between right or wrong or good or evil. I call it as I see or feel it and that’s my right to do so. How I feel about some things may not mean to much to others but when you look at the big picture, it may in fact impact others in one way or another. I have and will never stray from my personal responsibility. I mean what I say and I say what I mean. I retract when I am wrong and I embrace it when it’s the truth.

Walking the line is not for me. I can’t tell you how I feel but this phrase means nothing to me except that I am completely happy and satisfied with myself and know that no matter what you think of me, I don’t see two faces in the mirror when I awake as I address the morals in our society and workplace each day.

If there is one thing I would or might regret is that I can’t write too much about the good times. It seems that the bad days dwell over the good things like a dark cloud in the sky covering what needs to be seen.

I don’t throw rocks or stones at people but criticize their strategies, management principles and mostly perceived or inferred erroneous ways to do things. This unfortunately focuses on the bad times much more than those that are good like we want them to be.
